SALES AGREEMENT

This agreement is between TERESA SHCROEDER, dba NEW DESTINY HIMALAYANS, hereinafter referred to as the “SELLER”, and, ____________________________________ hereinafter referred to as the “BUYER”.

The SELLER hereby sells the following Persian-Himalayan Cat/Kitten to the BUYER for the total cash price of $_______________. Date of transaction ___________________.

HEALTH GUARANTEE: Seller guarantees that breeder’s cattery is FeLV negative, and this Cat/Kitten is presently free of internal or external parasites, infectious disease, or life-threatening congenital defects. TO VALIDATE THIS GUARANTEE, Buyer (at his/her expense) must have his/her veterinarian inspect this Cat/Kitten within seventy-two (72) hours of purchase. It is understood and agreed that Seller will not be responsible for the cost of such treatment. If major illness is found at this time, buyer must contact Seller IMMEDIATELY, and may at the option of the Seller:

A) Return this Cat/Kitten to Seller for refund up to purchase price, OR

B) Return this Cat/Kitten to Seller for replacement Cat/Kitten, if available, OR

C) Take this Cat/Kitten to Seller’s CHOICE of Veterinarian for a second opinion, in which case Seller will pay all reasonable costs up to purchase price of the feline.

During this 72-HOUR PERIOD, if a veterinarian other than one of Seller’s choice institutes any treatment or administers any further vaccinations, this Guarantee is null and void…

Seller also warrants that this feline is genetically sound, and will replace this feline with another at no additional cost if this feline ever dies of a congenital defect evident in at least one necropsy report presented to Seller within 24 hours of date preformed.

Buyer accepts the responsibility of caring for this Cat/Kitten and providing properly for its welfare. The Buyer agrees to follow the Seller’s instruction on care, housing, diet, treatment, and health.

Buyer agrees never to allow this Cat/Kitten outdoors for its health and safety……

Seller guarantees that at the time of purchase, this feline has no personality problems such as excessive fearfulness or aggression towards humans, or excessive litter box inconsistencies and will replace feline with feline of equal value if returned for this reason within 2 weeks of purchase.

If said Cat/Kitten is EVER given a F.I.P. (Feline Infectious Peritonitis) vaccination ALL guarantees are immediately null and void. (**This needs to be written in your vet’s records and make sure your vet understands).

Buyer understands that this feline has been spayed or neutered. Or Buyer must spay/neuter said feline after 2 weeks of purchase date, and before 8 weeks from purchase date. Failure to comply with this agreement will result in the buyer owing the Seller an additional $500.00….

Buyer agrees never to de-claw this feline, and understands that Seller feels that de-clawing is a mutilation and a cruelty that is likely to alter the temperament and health of the feline. If feline -despite serious, honest attempts to modify behavior – is excessively destructive with claws, Seller can dissolve this term in writing for the welfare of the feline and owner. If this agreement is dissolved, Buyer can only get said feline de-clawed at Sellers veterinary or agreed upon veterinary and feline can only be de-clawed in the front paws, not all four feet…

If Buyer cannot keep this Cat/Kitten for any reason at any time during it’s lifetime, Seller must be contacted before placement of Cat/Kitten, and given first right to reclaim said feline… Buyer is not allowed to re-sell, trade, or gift, said feline under any circumstances…

Buyer agrees that if feline is ever diagnosed with any health problems; i.e. Allergies, heart, eye, or kidney. The Seller is to be notified immediately, for breeder’s health records, and information.

Buyer understands and agrees if any of the terms in this agreement are disregarded, that Seller may reclaim this feline and any offspring without refund of purchase price, as Seller’s sole property.

The Buyer and Seller both agree that, except as contained in this agreement, no other promise, warranty, guarantee, or condition, either written or spoken, has been made by either party concerning this transaction. Further, Buyer and Seller agree that if any modifications or changes are made to this agreement, these must be made in writing and signed by both parties, to be effective.
